Can I get a business loan with an ATO debt?

Yes. ATO debt does not disqualify you from business finance, and clearing it is one of the most common reasons these loans are written. Banks generally want it cleared first, which is the loop most owners get stuck in. Property-secured and cash-flow lenders assess the debt as context rather than as a decline.

Short answer: Yes. ATO debt does not disqualify you from business finance, and clearing it is one of the most common reasons these loans are written. Banks generally want it cleared first, which is the loop most owners get stuck in. Property-secured and cash-flow lenders assess the debt as context rather than as a decline.

Why waiting on ATO debt got more expensive in 2025

From 1 July 2025 the general interest charge and the shortfall interest charge on ATO debts stopped being tax deductible (ATO). Before that change, the real cost of carrying a tax debt was softened at tax time. It is not any more.

The practical effect is that the arithmetic which used to favour carrying the debt often no longer does. Interest on a business loan taken to clear the debt is generally treated differently from the ATO’s own interest charge, which is the whole reason this became a live question for thousands of businesses in the last year rather than an accountant’s footnote. Your accountant should run the comparison on your figures before you decide.

The second effect is behavioural. The change has pushed a lot of owners into acting on debts they had been comfortably carrying, which means the ATO’s collection posture and the market’s appetite have both moved at once.

How lenders actually treat ATO debt

It splits cleanly by lender type, and knowing which door you are standing at saves weeks.

Lender typeView of ATO debtWhat that means for you
BanksGenerally want it cleared before they will proceedThe loop: you need finance to clear the debt, and they want the debt cleared to give you finance
Property-secured private lendersAssessed on equity and exit; the debt is contextUsually the fastest route, and the one that breaks the loop
Cash-flow lendersAssessed on trading; policy varies widelyWorkable for smaller debts where the account shows steady turnover
Invoice financeAssessed on the debtor ledgerUseful where the debt exists because customers pay slowly

The loop in the first row is the single most common reason business owners stay stuck with a tax debt for longer than they needed to. Breaking it usually means using property equity to clear the debt first, then refinancing to the bank afterwards once the file is clean — which is a well-worn path rather than a clever trick.

A loan or an ATO payment plan?

Not a rhetorical question, and the answer is not always the loan.

A payment plan costs nothing to arrange and does not put your property in the transaction. If the debt is modest, the business is trading normally and the plan is affordable, that is usually the right answer and no lender should talk you out of it.

A loan starts to make sense when one of four things is true. The plan has already failed once, because a second arrangement is harder to obtain and a failed one escalates quickly. The ATO has issued a garnishee or a director penalty notice, so the timeline is no longer yours. The debt is blocking something else — a refinance, a tender, a licence renewal, a sale — where the cost of being blocked exceeds the cost of the finance. Or the repayments under a plan would be tighter than the repayments on a loan over a sensible term.

The worst outcome is a plan entered at a repayment the business cannot actually meet, because the failure is worse than never having asked. Run the number honestly before you agree to it.

Which loan suits an ATO debt?

  • You own property: a second mortgage or caveat loan. No financials required, overdue lodgements are fine, bad credit considered, and up to $5 million. This is the most common route for debts above about $50,000.
  • You own property and want the cheapest structure: if the property is unencumbered, a first mortgage is generally the lowest-cost option we offer.
  • No property, steady trading: a cash-flow loan, assessed from bank statements. Works well for smaller debts where the account shows consistent turnover.
  • Debt caused by slow-paying customers: invoice finance addresses the cause rather than the symptom, though it is the slowest product to put in place.

What to have ready

Four things will get you an answer the same day.

  1. The ATO balance, from a statement of account or the portal — the actual figure, including any interest already accrued.
  2. Whether an arrangement exists, and whether it is current or has already defaulted.
  3. Any notice you have received. A garnishee, a director penalty notice or a firmer-than-usual letter all change the timeline and should be mentioned first, not last.
  4. The property details, if you own one: the address, roughly what is owing, and who is on the title.

Act before the deadline, not on it

Every part of this gets easier the earlier it starts. An arrangement that has not yet defaulted is worth more than one that has. A garnishee that has not issued is easier to avoid than to unwind. A lodgement brought up to date opens the refinance that clears everything properly.

If the date is already on you, that is what same-day assessment exists for — but the file that starts on Tuesday for a Friday deadline has options that the file starting Friday morning does not.

Frequently asked questions

Will a lender decline me because I have ATO debt?

Not a lender that works in this space. The debt is usually the reason for the loan rather than a reason to refuse it. What matters is the size of it relative to the business and whether there is a way to repay the new loan.

Do you need to see my ATO portal or a statement of account?

A recent statement of account or a portal screenshot showing the balance is the most useful single document. It confirms the figure and whether an arrangement is in place.

Does a garnishee notice change anything?

It makes it urgent rather than impossible. A garnishee means the ATO is collecting directly, so the deadline is real. Files like this are common and are usually funded within a day.

Can I borrow more than the debt?

Often, yes, and sometimes you should. Clearing the debt and leaving nothing for the cash-flow gap that created it frequently produces the same problem a quarter later.

What if my returns are not lodged?

Overdue lodgements do not stop a property-secured application, because the assessment is on equity and exit rather than financials. They will stop a bank refinance, which is often why the second-mortgage route gets used first.

Does it cost anything to apply?

No. There's no cost to apply or check your eligibility. All costs are set out in writing in your loan offer before you sign anything.

Will checking my eligibility affect my credit score?

No. Our 60-second eligibility check doesn't make a credit enquiry. A credit check is only done later, with your consent, if you decide to proceed.
